Occupational Injuries
A work-related injury may be the result of an accident such as a slip and fall injury, or an occupational disease that developed over time, like an asbestos-related illness. A workplace injury may be covered by Workers’ Compensation laws, toxic tort law or both. Often times, workers do not realize that their work-related incident may be compensated.
Here are a few examples of workplace injuries:
- A traumatic incident while on location (such as construction work or a job where you are required to operate high machinery)
- A muscle strain or fracture (such as a job lifting heavy objects or unloading trucks)
- A repetitive injury (such as Carpal Tunnel Syndrome) or a chronic condition (like chronic back pain)
- A slip and fall accident because of an unsafe work environment
- Prolonged exposure to hazardous materials (such as asbestos) that leads to long-term breathing problems
- An injury due to insufficient training or a lack of protective gear and/or safety equipment
Workplace Discrimination
Workplace discrimination is the unlawful and intentional act of unfair treatment of an employee based on characteristics such as:
- Age
- Disability
- National origin
- Religion
- Pregnancy
- Gender (sex)
Some states also implement laws protecting employees against discrimination on the basis of marital or familial status or sexual preference. If you are being treated unfairly at work, you have the right to representation. Some examples of workplace discrimination include:
- Verbal harassment
- Physical harassment
- Sexual harassment
- Failure to promote
- Demotion
- Loss of benefits
- Suspension or determination
- Hostile work environment (the creation of an uncomfortable environment)
- Failure to reasonably accommodate a qualifying employee with a disability
