A vagus nerve stimulator called a NeuroCybernetic Prosthesis (NCP) system was approved by the Food and Drug Administration (FDA) in 1997 to control seizures. However, this system was found to be linked to 83 deaths and more than 100 infections. If you have used this system to control seizures and have suffered an injury or other health problems, please contact the personal injury lawyers at Balkin & Eisbrouch, LLC.

How the NCP System Works

Manufactured by Cyberonics, Inc., the NCP system consists of a generator that is implanted beneath your collar bone like a pacemaker and is connected by a wire to the vagus nerve in your neck. An electric signal is then transmitted in periodic intervals to your vagus nerve. This charge aims to control and reduce the severity and occurrences of epileptic seizures.

The system includes an external programming system that your doctor uses to change the stimulation settings. Patients can turn the stimulator on and off with a hand-held magnet by holding it overtop of the stimulator.

The NCP system was intended to be used in correlation with drugs or surgery in adults and adolescents who suffer from seizures called “partial onset seizures.” These types of seizures begin in one part of the brain and may remain localized or become generalized to the entire brain.

Improper Reporting

In March of 2001, the FDA sent a warning letter to Cyberonics after receiving reports of 83 deaths and countless infections associated with the NCP system. In its letter, the FDA accused the company of improperly reporting and failing to record these tragic incidents. The FDA also accused the company of failing to investigate the cause of these deaths.

Medical Device Injuries

If you are a victim of a medical device injury, like that of the NCP system, or if your medical device or product has been recalled, you have the right to collect damages for any injuries caused by the defective device. Typically, in a medical device lawsuit, the injured party suffers from a “signature injury” that is well-recognized in the medical field and that a qualified lawyer like those at Balkin & Eisbrouch, LLC can attribute to a specific medical device.

If you have suffered injuries because of the NeuroCybernetic Prosthesis System, please contact the defective products attorneys at Balkin & Eisbrouch, LLC as soon as possible to help protect your legal rights. Please keep in mind that there may be time limits within which you must begin your claim, so do not hesitate. We serve clients in the United States, Puerto Rico and Canada.
