Q. How will you be able to find out who is responsible for the fire or explosion or other mishap that has caused my scarring or disfigurement?
A. In addition to obtaining a copy of all police, fire, and emergency medical records, Balkin & Eisbrouch will, depending on the case, send out our own investigator to identify and interview witnesses. Balkin & Eisbrouch will also inspect and photograph the site of the mishap. We will retain any experts, whether electrical experts, chemists, engineers, or the like, who may be needed to determine the origin and cause of the fire or mishap. We will also identify and examine all records, whether written or taped, that may have information relevant to your case.
Q. Who will pay for my medical bills?
A. As part of your case, Balkin & Eisbrouch will fight to have the party responsible pay for all of your medical bills, both those you have already incurred and those you will incur in the future. (It is important to not only consider what your medicals bills are today, but what they will be in the future, to make sure that you are not left with a mountain of medical bills to pay.) If you do not have existing medical insurance coverage to pay for your medical costs prior to any settlement in your case, we will assist you in pursuing both public and private sources for the payment of these bills. Often, the party responsible for injury has some medical coverage that will be available even before the parties can come to an agreement on the settlement of a case.
Q. Will someone pay for my plastic/reconstructive surgery?
A. Your claim will include a demand for payment of plastic/reconstructive surgery. We understand that this is not simply a cosmetic consideration, but one that is important to the healing process, self-esteem and daily living. In some cases, reconstructive surgery treatment may not commence until some time after your accident. Additionally, some burns and disfigurements require repeated surgeries to correct. Balkin & Eisbrouch will not allow the high costs of such care to be overlooked by the responsible party.
Q. What if I am left with scarring or disfigurement that cannot be corrected by surgery?
A. Permanent scars or disfigurements will be part of your claim for pain and suffering. The mental distress caused by such scars and disfigurements can have a devastating effect on a persons quality of life. This is a profound loss for which you should be compensated. Depending on the severity of the scarring or disfigurement you are left with, Balkin & Eisbrouch may retain an expert on your behalf who will demonstrate the effect your scarring or disfigurement may have on your employability.
